For a consideration received I do hereby sell to John Matson one half interest in a water ditch beginning in Section 10 T39 R13 E and terminating in SW quarter of Sec 5 S39 R13 E. If said ditch cannot carry the water needed by John Bergstrom and John Matson it shall be John Matson's duty to enlarge the same. Nothing herein shall be so construed as to give John Matson right to use any water out of the above mentioned ditch needed by John Bergstrom.
