Notice of Appropriation of Water. Sections 1410 — 1422. hereby appropriates 50 ft. in depth, being about 60,000,000 cubit feet of water, all water flowing into that certain reservoir known as Moffitts Reservoir in secs, 9 and 10 Tp.45 N, R 17 E, M.D.B. and M, in Modoc County, California.

Notes: Named reservoir (Moffitt's Reservoir) — existing natural feature. 50-FOOT DAM — tallest proposed in all records. Dam at point about 63 ft S 48° E of a Juniper tree on west side. Innovative: pipe from dam to DRY CREEK BED which serves as natural ditch to Surprise Valley. Volume-based claim (60M cubic feet) not flow-based. Witness C.H. Fenner — president of Surprise Valley Irrigation & Power Company (Cowhead Lake scheme)! Connection to Fenner suggests Moffitt in same social/business circle. Filed at request of R. Moffitt.
