Notice is hereby given that I claim the right (in the future as in the past) to appropriate all the water flowing in the Montgomery branches of Stones Creek, in excess of that now used by Thos. Montgomery, to the amount of 75 inches more or less, diverting the same at a point near the head of the main branch in a company ditch 4 feet wide & one foot deep, also the right to take the same from said Company Ditch at a point near the North west corner of Thomas Montgomery's Church in a ditch of like capacity, carrying the same on to the South East quarter of Section 12, Township 39 North, Range 12 East.
